  3. Identification of the infringing material and information sufficient to locate it
  4. Your contact information (postal address, telephone number, email)
  5. A statement of good faith belief that the use is not authorized
  6. A statement, under penalty of perjury, that the information is accurate and you are authorized to act

3. Our Response to Infringement Notices

Upon receiving a compliant notice, we will remove or disable access to the material, notify the user who posted it, and inform them of their right to submit a counter-notice.

4. Repeat Infringer Policy

  • Service will be terminated upon receiving six (6) complaints for the same IP address or account within a twelve (12) month period
  • A complaint is not counted if the user filed a valid counter-notice and no further legal action was taken
  • A court finding of infringement is not required; determination is at our sole discretion
  • A DMCA Administrative Fee may apply for each complaint after the second notice

A user whose service is terminated may not establish a new account under any name.

5. Counter-Notice Procedure

If your material was removed due to mistake or misidentification, you may submit a counter-notice containing:

  1. Your physical or electronic signature
  2. Identification of the removed material and its prior location
  3. A statement under penalty of perjury of good faith belief of mistake or misidentification
  4. Your contact information and consent to the jurisdiction of the Federal District Court for the District of Arizona

We will forward the counter-notice to the original complainant (including your personal information). If they do not file a court action within ten (10) business days, we may restore the material at our discretion.
