MILE HIGH NETWORKS LLC ACCEPTABLE USE POLICY Effective February 2025
By subscribing to any residential or commercial broadband Internet Service (collectively, the “Services” and individually, a “Service”) provided by Mile High Networks LLC (“Mile High Networks”), you (the “Customer”) agree not to use the Services for any unlawful purpose and to comply with all policies and terms of this Acceptable Use Policy (the “AUP” or “Policy”). This Policy, including its use restrictions, supplements the restrictions in Mile High Networks’ Master Services Agreement (“Service Agreement”), which you previously entered into with Mile High Networks. This Policy is incorporated by reference into the Service Agreement.
Please read this Policy carefully before accessing the Services. The term “Customer” refers to the subscriber and any user of the Service. By using the Services, you agree to the terms of this Policy and must require others using the Service through your account to abide by it. Mile High Networks regularly updates and amends this Policy (and may do so without notice at its discretion). You should periodically review the Mile High Networks website to ensure ongoing compliance. Your continued use of the Service constitutes your acceptance of this Policy and any posted amendments.
Mile High Networks reserves the right to reclassify any Service to a higher grade or to immediately suspend or terminate any Service without prior notice if you fail to comply with any portion of this Policy or the Service Agreement. (See the Service Agreement for details on suspension and termination.) Upon such termination, you remain responsible for the full month’s charges through the end of the current term, including unbilled charges, plus any applicable termination fee, all of which become immediately due and payable. Violations of this Policy or the Service Agreement may also result in prosecution under state and/or federal law. Mile High Networks will cooperate with law enforcement by providing information in response to requests, subpoenas, court orders, to protect its rights and property, or where failure to disclose may lead to imminent harm to a Customer or others.
Mile High Networks may access or collect the following Customer data: name, email address, location, user’s phone, contact book data, user’s inventory of installed apps, and user’s screen recording. This data will not be sold to third parties and will be used solely to improve the customer service experience. This policy also applies to any Mile High Networks Mobile Application.
For copyright infringement claims, you understand, acknowledge, and agree that Mile High Networks may remove any content alleged to infringe a third party’s copyrights upon receiving a notice under the Digital Millennium Copyright Act (“DMCA”) and may terminate your Service without prior notice for repeat infringement. 1. PERMITTED USE Your permitted use of the Services depends on whether they are requested for residential or commercial purposes.
Residential Service includes all Services designated for personal and family use within a single home (including any apartment, condominium, flat, or other residential unit in a multiple dwelling). Only you and co-residents living in the same home may use the Services. The Services are provided solely for residential use in your home. Any unauthorized third-party access to email, Internet access, or other functions violates this Policy and the Service Agreement. You are solely responsible for any misuse through your account, whether by household members, guests, or authorized/unauthorized third parties. You may not use (or allow others to use) the Service to operate any business or commercial enterprise, including IP address translation or similar facilities for additional access. You may not advertise the Service as available to third parties or unauthorized users, nor resell or redistribute (or allow others to resell or redistribute) access in any manner, including via wireless technology.
Commercial Service includes all Services designed for use by a business entity or individual providing goods or services for sale or lease. Only your employees and patrons may utilize the Commercial Service within your office area. The Service is provided solely for your business operations. Any unauthorized third-party access to email, Internet access, or other functions violates this Policy and the Service Agreement. You are solely responsible for any misuse through your account, whether by employees, patrons, invitees, guests, or authorized/unauthorized third parties.
2. GENERALLY PROHIBITED ACTIVITIES FOR ALL SERVICES
Misuse of Services — You are responsible for any misuse of the Services, regardless of whether committed by an invitee, licensee, agent, servant, guest, patron, employee, or any other person who gains access. You must take steps to prevent unauthorized access, such as maintaining password confidentiality and protecting your computer, network, or wireless devices. You are solely responsible for the security of any device connected to the Services, including data stored on it.
Objectionable Use and Content — Prohibited activities include: (i) any use that is threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of privacy or other rights, or otherwise objectionable in Mile High Networks’ sole discretion; (ii) use in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming, or duplicative/unsolicited messages not compliant with the federal CAN-SPAM Act or Telephone Consumer Protection Act; (iii) publishing, distributing, or disseminating inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful material or information; (iv) advertising, soliciting, selling, buying, or attempting to buy/sell goods for non-personal purposes under residential Services; (v) harvesting or collecting others’ information (including email addresses or telephone numbers) without consent; (vi) creating a false identity to mislead others about the sender’s identity or message/call origin; (vii) transmitting or uploading material containing viruses, Trojan horses, worms, time bombs, cancel bots, or other harmful programs/software, or material protected by intellectual property, privacy, publicity, or other laws unless you own/control the rights or have all necessary consents; (viii) interfering with or disrupting connected networks or violating their regulations, policies, or procedures; and (ix) attempting unauthorized access to the Service, other accounts, systems, devices, or networks via password mining or other means; hosting publicly accessible file sharing, gaming, or email servers (e.g., HTTP, FTP, SMTP, POP3, Peer-to-Peer); or interfering with others’ use and enjoyment of the Service or similar services.
3. PROHIBITED INTERNET SERVICE ACTIVITIES You must use the Internet Service and related Equipment only for lawful purposes. Prohibited activities include but are not limited to:
Background and/or server-type applications — Including IRC bots, HTTP servers, MUDs, and any other process initiated by you that continues execution after logout. FCC-authorized smart home systems and IoT devices are excluded.
Attempts to compromise system and/or network security — Programs such as packet sniffers, password crack utilities, or similar tools running from your account are prohibited. This includes attempts to hack non-Mile High Networks systems, networks, servers, websites, or applications via the Mile High Networks network.
Sharing of accounts — Sharing the Internet Service with another party to avoid payment for a second Service is strictly prohibited. You may connect multiple computers/devices within a single location to your modem, router, and/or radio via a single Mile High Networks-issued IP address.
Conducting commercial business through a personal residential account — Residential accounts are designed for home/casual use and may lack the service level, capacity, or speed for commercial activity. Running a business on a residential account is not advisable. Contact the Mile High Networks sales department to upgrade to a commercial account.
Email abuse — This includes sending/transferring messages to unsolicited recipients in violation of the CAN-SPAM Act, sending harassing/threatening messages, or forging email addresses to impersonate others.
Pyramid/money-making schemes — Transferring information or soliciting persons via the Internet to extort money/valubles or using pyramid/chain letters is prohibited.
